By downloading, installing, accessing, or using the KNOWCAL application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not download, install, access, or use the App.
The App is licensed, not sold, to you by KNOWCAL ("Company", "we", "us") for use strictly in accordance with these Terms. This license is granted to you as the end user and you may not transfer or sell this license to another party.
Your privacy matters to us. Our Privacy Policy, which is incorporated by reference into these Terms, explains how we collect, use, and share information about you when you use our App. Please read it carefully.
KNOWCAL offers auto-renewing subscription options to access premium features.
Subscription length options include: monthly, quarterly, and annual plans.
Pricing is clearly displayed before purchase in the App.
Payment will be charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless auto-renew is turned off at least 24-hours before the end of the current period.
Account will be charged for renewal within 24-hours prior to the end of the current period at the rate of your selected plan.
You can manage your subscription and turn off auto-renewal by going to your Account Settings in the App Store after purchase.
No cancellation of the current subscription is allowed during the active subscription period.
Any unused portion of a free trial period will be forfeited when you purchase a subscription.
To use certain features of the App, you must create an account with a username and password, or use an available third-party login service including Sign in with Apple.
You are responsible for maintaining the confidentiality of your account credentials.
You agree to accept responsibility for all activities that occur under your account.
You must immediately notify us of any unauthorized use of your account.
You have the right to delete your account and associated data at any time.
Account deletion can be initiated within the App under Settings > Account > Delete Account.
Account deletion is permanent and cannot be reversed. All your personal data will be deleted in accordance with our Privacy Policy.
"User Content" refers to any information, data, or material that you submit, upload, or otherwise make available through the App, including food logs, photos, weight information, and other health-related data.
You retain all ownership rights to your User Content.
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purposes of operating and improving the App.
You agree not to submit User Content that:
Infringes on anyone's intellectual property rights
Contains software viruses or any other malicious code
Is illegal, harmful, threatening, abusive, or otherwise objectionable
Impersonates any person or entity or misrepresents your affiliation
KNOWCAL is a calorie tracking tool and does not provide medical advice.
The App is not intended to diagnose, treat, cure, or prevent any disease or health condition.
You should consult with a healthcare professional before making any dietary or fitness changes.
While we strive for accuracy, we cannot guarantee the precise nutritional content of all foods in our database.
Users should verify important nutritional information when making health-critical decisions.
The App, including all content, features, and functionality, is owned by the Company and is protected by copyright, trademark, and other intellectual property laws.
You agree not to:
Modify, adapt, or hack the App
Reverse engineer or attempt to extract the source code
Remove any copyright or proprietary notices
Transfer, sell, or sublicense the App to any third party
You may terminate your use of the App at any time by deleting your account and uninstalling the App.
We may terminate or suspend your access to the App immediately, without prior notice, if:
You breach these Terms
We are required to do so by law
We decide to discontinue the App
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last Updated" date at the beginning of these Terms and, where appropriate, by in-app notification. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
These Terms shall be governed by the laws of Thailand, without regard to its conflict of law provisions.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding your use of the App and supersede any prior agreements between you and the Company relating to the App.
